NOTICE is hereby given that the City of West Melbourne, Brevard County, Florida, has called for Public Hearing(s) to be held as follows:

West Melbourne Planning and Zoning Board, November 7, 2023, 6:30 p.m., or as soon thereafter as the matter may be heard in the City Council Chambers, 2285 Minton Road West Melbourne, Florida. This meeting may include the attendance of one (1) or more members of the West Melbourne City Council who may or may not participate in the Board discussions held at this public meeting. The Planning and Zoning Board will take public comment, consider the proposed amended and restated development agreement and make a recommendation to the City Council. 

West Melbourne City Council, November 14, 2023, at 6:00 p.m., or as soon thereafter as the matter may be heard in the Council Chamber located at 2285 Minton Road, West Melbourne, Florida.  The City Council will take public comment, the Planning and Zoning Board’s recommendation and consider the following:

A request for an amended and restated development agreement for Madison Holdings of Brevard, LLC on +/- 9.93 acres of property located at 9075 Ellis Road on property more particularly described as follows: 

PARCEL 1

The North 1/2 of the Northwest 1/4 of the Northeast 1/4 of Section 35, Township 27 South, Range 36 East, Less and Except the West 250 feet and the East 330 feet thereof and excepting therefrom road Right of Way for Ellis Road (50' Right of Way), Public Records of Brevard County, Florida.

LESS AND EXCEPT

PARCEL 2

Commencing at the North 1/4 corner of Section 35, Township 27 South, Range 36 East, thence S 00 degrees 04' 22" E along the West line of the Northwest 1/4 of the Northeast 1/4 of aforementioned Section 35 for a distance of 50.00 feet to a point of intersection with the South Right of Way of said Ellis Road (50' Right of Way) Thence N 89 degrees 44' 50" E along said South Right of Way for a distance of 991.21 feet; Thence S 00 degrees 04' 58" E for a distance of 321.56 feet to the Point of Beginning of the herein described parcel; Thence continue S 00 degrees 04' 58" E, a distance of 259.72 feet to the South line of the North 1/2 of Northwest 1/4 of Northeast 1/4 of said Section 35; Thence S 89 degrees 43' 01" W along said South line of aforementioned North 1/2 of the Northwest 1/4 of Northeast 1/4 of said Section 35 for a distance of 96.18 feet; Thence N 00 degrees 04' 58 "W a distance of 193. 63; Thence N 55 degrees 17' 05" E, a distance of 116.89 feet to the Point of Beginning

The proposed development agreement is available for public inspection at City Hall, 2240 Minton Road, West Melbourne, Florida. All persons wishing to be heard should appear in person at these hearings or send written comments to the City Clerk.  All persons and parties are hereby advised that if they should decide to appeal any decision made by the City with respect to any matter considered at the public meeting or hearing described in this notice, they will need a record of the proceedings, and for such purpose, said person or party may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based (Chapter 286, Florida Statutes).  In compliance with the Americans with Disabilities Act (ADA), anyone who needs a special accommodation for this meeting should contact the City Clerk at (321) 837-7774 at least 48 hours in advance of this meeting. The public hearing may be continued to a time and date certain by announcement at this scheduled hearing without any further published notice.
