NOTICE is hereby given that the City of West Melbourne, Brevard County, Florida, has called for Public Hearing(s) to be held as follows:

West Melbourne Planning and Zoning Board, November 7, 2023, 6:30 p.m., or as soon thereafter as the matter may be heard in the City Council Chambers, 2285 Minton Road West Melbourne, Florida. This meeting may include the attendance of one (1) or more members of the West Melbourne City Council who may or may not participate in the Board discussions held at this public meeting. 

West Melbourne City Council, November 14, 2023, at 6:00 p.m., or as soon thereafter as the matter may be heard in the Council Chamber located at 2285 Minton Road, West Melbourne, Florida.  The City Council will take public comment, the Planning and Zoning Board’s recommendation and consider the following:

A request for small scale comprehensive plan amendment, (SSA) to change the land use designation on a total of 6.89 +/- acres of property on the east side of Simon Road located at 5305 Cattle Drive and assigned Parcel Identification Numbers 28-36-10-00-268 and 28-36-10-00-275 by the Property Appraiser of Brevard County, from Brevard County Residential 1 (RES-1) to City of West Melbourne Low Density Residential (LD-RES) and to consider rezoning from Brevard County AU (Agricultural Residential) to City of West Melbourne R-A (Residential Agricultural), on property more particularly described as follows: 

Parcel ID 28-36-10-00-268

The South 1/2 of the North 1/2 of Lot 25, Section 10, Township 28 South, Range 36 East, Plat of Florida Indian River Land Company, according to the map or plat thereof, as recorded in Plat Book 2, Page(s) 80, of the Public Records of Brevard County, Florida, less the right of way for Simon Road. Containing 5.0 acres, more or less.

A portion of the North 1/2 of the North 1/2 of Lot 25, Section 10, Township 28 South, Range 36 East, Florida Indian River Land Company Subdivision as recorded in Plat Book 2, Page 80 Public Records of Brevard County, Florida, being more particularly described as follows: Commence at the Northwest Comer of said Section 10; Thence N89°42'58"E along the North line of said Section 10 a distance of 20' to the East right of way of Simon Road; Thence S0°47’11”W along said East right of way a distance of 176.53' to the point of beginning of the herein described parcel; Thence continue along said East right of way S0°47'11''W a distance of 128.53' to the north line of a 25' engress and egress easement; Thence N89°43'56"E, 639.34' to the East line of said lot 25; Thence N0°50'14"E along said lot line a distance of 128.63’; Thence S89º43'24"W a distance of 639.46' to the point of beginning. Containing 1.888 acres more or less.

The Planning and Zoning Board will take public comment, consider the items, and make a recommendation to the City Council. 

The proposed comprehensive map amendments and rezonings are available for public inspection at City Hall, 2240 Minton Road, West Melbourne, Florida. All persons wishing to be heard should appear in person at these hearings or send written comments to the City Clerk.  All persons and parties are hereby advised that if they should decide to appeal any decision made by the City with respect to any matter considered at the public meeting or hearing described in this notice, they will need a record of the proceedings, and for such purpose, said person or party may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based (Chapter 286, Florida Statutes).   In compliance with the Americans with Disabilities Act (ADA), anyone who needs a special accommodation for this meeting should contact the City Clerk at (321) 837-7774 at least 48 hours in advance of this meeting. The public hearing may be continued to a time and date certain by announcement at this scheduled hearing without any further published notice.
