NOTICE is hereby given that the City of West Melbourne, Brevard County, Florida, has called for a Public Hearing to be held as follows: West Melbourne Board of Adjustment, October 24, 2019, 7:00 p.m., or as soon thereafter as the matter may be heard in the Council Chamber located at 2285 Minton Road, West Melbourne, Florida.
The purpose of this hearing will be to consider the following: A request for a conditional use and site plan approval as provided in Chapter 98, Article III., Division 21. – Community Redevelopment Area Districts (C-NH and C-W), Sec. 98-832 (22) Service stations, gas stations use in the C-NH of the Code of Ordinances to allow for development of a RaceTrac gas station at the southeast corner of Wickham Road and Nasa Boulevard on the following described property:
A PARCEL OF LAND IN THE NORTHEAST ONE QUARTER OF SECTION 36. TOWNSHIP 27 SOUTH, RANGE 36 EAST, BREVARD COUNTY, FLORIDA, BOUNDED ON THE EAST BY CRANE CREEK DRAINAGE DISTRICT CANAL L-7 AND MORE PARTICULARLY DESCRIBED AS FOLLOWS:
COMMENCING AT THE NE CORNER OF SAID SECTION 36, RUN S87"52'25"W ALONG THE NORTH LINE OF THE NORTHEAST ONE QUARTER OF SAID SECTION 36 A DISTANCE OF 49.53 FEET; THENCE RUN S00"19'11"E A DISTANCE OF 20.01 FEET TO A POINT ON THE WEST RIGHT OF WAY LINE OF SAID CANAL L-7 ( A 99 FOOT WIDE RIGHT OF WAY) AND ON THE SOUTH RIGHT OF WAY LINE DESCRIBED IN OFFICIAL RECORDS BOOK 2223, PAGE 832 OF THE PUBLIC RECORDS OF BREVARD COUNTY, FLORIDA, SAID POINT BEING THE POINT OF BEGINNING OF THE HEREIN DESCRIBED PARCEL; THENCE RUN S87"52'25"W ALONG SAID SOUTH RIGHT OF WAY LINE A DISTANCE OF 294.32 TO THE EAST RIGHT OF WAY LINE OF WICKHAM ROAD AS DESCRIBED IN OFFICIAL RECORDS BOOK 2558, PAGE 2194 OF THE PUBLIC RECORDS OF BREVARD COUNTY, FLORIDA; THENCE RUN soo·10'48"E ALONG SAID WEST RIGHT OF WAY LINE A DISTANCE OF 305.87 FEET; THENCE RUN N87'54'36"E A DISTANCE OF 281.05 FEET TO THE WEST RIGHT OF WAY LINE OF SAID CANAL L-7; THENCE RUN N00'19'11"W ALONG SAID WEST RIGHT OF WAY LINE A DISTANCE OF 306.03 FEET TO THE POINT OF BEGINNING.
The public hearing may be continued to a time and date certain by announcement at the scheduled hearing without any further published notice. All persons wishing to be heard should appear in person at these hearings or send written comments to the City Clerk. All persons and parties are hereby advised that if they should decide to appeal any decision made by the City with respect to any matter considered at the public meeting or hearing described in this notice, they will need a record of the proceedings, and for such purpose, said person or party may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based (Chapter 286, Florida Statutes).
