Public Notice - Annexation

The City of West Melbourne, Florida is proposing to annex certain unincorporated property contiguous to the City boundaries. The 24.64 acres, more or less, of land proposed for annexation into the corporate boundaries of the City is generally located west of Interstate 95, on the north side of U.S. 192 at the intersection of St. Johns Heritage Parkway and U.S. 192 and identified as parcel 28-36-03-00-252 by the Brevard County Property Appraiser’s office. The legal description and proposed annexation ordinance can be obtained from the City Clerk at the West Melbourne City Hall, 2240 Minton Road, West Melbourne (321-837-7774). 

The West Melbourne City CouncilMap showing location of proposed annexation for Ordinance No. 2019-20 will hold public hearings regarding this proposed voluntary annexation.  The first public hearing will be held August 20, 2019, and the second public hearing will be held on September 17, 2019. Both public hearings will begin at 6:30 p.m., or as soon thereafter as may be heard, in the City Council Chambers, located at 2285 Minton Road, West Melbourne.

ORDINANCE NO. 2019-20 

AN ORDINANCE OF THE CITY OF WEST MELBOURNE, BREVARD COUNTY, FLORIDA, ANNEXING BY VOLUNTARY PETITION A PARCEL OF LAND TOTALING APPROXIMATELY 24.64 ACRES LOCATED WEST OF INTERSTATE 95, ON THE NORTH SIDE OF U.S. 192 AT THE INTERSECTION OF ST JOHNS HERITAGE PARKWAY AND U.S. 192, AS MORE FULLY DESCRIBED HEREIN; FINDING THAT THE AREA BEING ANNEXED IS REASONABLY COMPACT AND CONTIGUOUS TO THE CITY, THAT THE ANNEXATION OF THE PROPERTY DOES NOT CREATE AN ENCLAVE, AND THAT THE ANNEXATION OF THE PROPERTY OTHERWISE COMPLIES WITH FLORIDA LAW; AMENDING THE CORPORATE BOUNDARIES OF THE CITY TO PROVIDE FOR THE INCORPORATION OF THE REAL PROPERTY DESCRIBED HEREIN; PROVIDING FOR FILING OF THE REVISED CITY BOUNDARIES WITH THE DEPARTMENT OF STATE; PROVIDING FOR REPEAL OF PRIOR INCONSISTENT ORDINANCES AND RESOLUTIONS; PROVIDING FOR SEVERABILITY; AND PROVIDING AN EFFECTIVE DATE.

Notice is hereby given that all interested parties may appear at the meeting and be heard by City Council. All persons wishing to be heard should appear in person at these hearings or send written comments to the City Clerk. All persons and parties are hereby advised that if they should decide to appeal any decision made by the City Council with respect to any matter considered at the public meeting or hearing described in this notice, he or she will need a record of the proceedings, and for such purpose, he or she may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based (Chapter 286, Florida Statutes). In compliance with the Americans with Disabilities Act (ADA), anyone who needs a special accommodation for this meeting should contact the City Clerk at (321) 837-7774 at least 48 hours in advance of this meeting.
